You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use. This license does not include any right to resell or commercial use of the Service or its contents, any collection and use of product listings or descriptions, any derivative use of the Service or its contents, or any use of data mining, robots, or similar data gathering and extraction tools.
6. User Content
The Service may allow you to post, submit, publish, or display content, including but not limited to listings, reviews, comments, messages, and other materials (collectively, "User Content"). You retain ownership of any intellectual property rights that you hold in your User Content. By posting User Content on garagestall.com, you grant Garage stall a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service.
You represent and warrant that you own or have the necessary rights to post your User Content and that your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person or entity. Garage stall does not endorse any User Content or any opinion, recommendation, or advice expressed therein. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. GARAGE STALL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Garage stall does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that garagestall.com or the servers that make it available are free of viruses or other harmful components. We do not warrant or make any representations regarding the use or the results of the use of the Service in terms of its correctness, accuracy, reliability, or otherwise.

We are not responsible for the accuracy, legality, or quality of listings or the ability of users to complete transactions. Any transactions you enter into with other users are solely between you and such users.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GARAGE STALL, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
IN NO EVENT SHALL GARAGE STALL'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO GARAGE STALL, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such jurisdictions, Garage stall's liability will be limited to the greatest extent permitted by law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Garage stall, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms of Service
- Your use of the Service, including but not limited to your User Content
- Your violation of any rights of another person or entity
- Your violation of any applicable laws, rules, or regulations
Garage stall reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses. This indemnification obligation will survive the termination of these Terms and your use of the Service.
10. Termination
Garage stall may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to your breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability. Termination of your account does not relieve you of any obligations incurred prior to termination.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Garage stall is headquartered, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in the applicable jurisdiction, and you consent to the personal jurisdiction of such courts.
You and Garage stall agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and Garage stall each waive any right to a jury trial.
12. Changes to Terms
Garage stall reserves the right to modify or replace these Terms at any time at our sole discretion.
